Section C: Student Rules, Responsibilities and Policies

Sexual Harassment and Sexual Violence

Minnesota State College Southeast works diligently to maintain a learning and working environment that is free from sexual harassment and sexual violence. Southeast will not tolerate any form of sexual harassment or sexual violence and will act to investigate all complaints, formal or informal, written or verbal. Sexual harassment is a form of sexual discrimination. Sexual violence is a physical act of aggression that includes a sexual act or sexual purpose. Individuals of any gender may be victims or offenders.

It shall be a violation of this policy for any student or employee of the college to sexually harass or to be sexually violent to another student or employee through conduct or communication of a sexual nature as defined by this policy. This policy also includes any extension of the college environment, e.g., college-sponsored events, customers, and/or vendors.

Consistent with requirements of applicable college student and employee policies, collective bargaining agreements, and statutes, the President or designee will take disciplinary action as deemed appropriate, including warning, suspension, or immediate discharge, to end sexual harassment/sexual violence found to exist and to prevent its recurrence. A copy of the policy is available to all students and staff.

Southeast is committed to eliminating sexual violence in all forms and will take appropriate remedial action against any individual found responsible for acts in violation of this policy. Acts of sexual violence may also constitute violations of criminal or civil law, or other Board Policies, which may require separate proceedings.

The college adopts Minnesota State Board Policy 1B.3, Sexual Violence Policy, and Minnesota State Board Procedure 1B.3.1 as its policy and procedure.
